Eligibility to Use Our Website
You must be legally capable of entering into a binding agreement to place an order through our website.
If you are under 18 years of age, you should use our website and purchase products only with the involvement and permission of a parent or guardian.

You must not use our website or products for an unlawful purpose.

You may be able to create a customer account to access features such as:
-
Order history.
-
Saved customer details.

-
Product preferences.
-
Faster checkout.
You agree to provide accurate, current and complete account information.
You are responsible for:
-
Maintaining the confidentiality of your login details.
-
Restricting access to your account.
-
Activity conducted through your account where you authorised that activity or failed to take reasonable steps to protect your login details.
-
Promptly telling us if you believe your account has been accessed without authorisation.
We may suspend or restrict an account where we reasonably believe it has been:
-
Accessed without authorisation.
-
Used fraudulently.
-
Used to abuse discounts, rewards or promotions.
-
Used in breach of these Terms.
-
Used in a way that creates a security or legal risk.
Where reasonably practicable, we will notify you and provide an opportunity to address the issue.
Product Information
We take reasonable steps to provide accurate product information, including:
-
Product names.
-
Images.
-
Descriptions.
-
Ingredients.
-
Directions.
-
Warnings.
-
Sizes.
-
Flavours and colours.
-
Nutritional information.
-
Prices.
-
Availability.
Product manufacturers may change packaging, labels, formulations, ingredients or specifications without immediately notifying retailers.
As a result, packaging or labels received may sometimes differ from website images. A minor packaging or design variation that does not materially change the product will not necessarily mean the product is faulty or misdescribed.
You should always read the physical product label, ingredient list, directions and warnings before using a product.
Where information on the physical product differs from information displayed on our website, do not use the product until you have checked the current information and, where necessary, contacted us or the manufacturer.
Nothing in this section limits your rights where a product is materially different from its description or does not meet a consumer guarantee.
Colours and Product Images
We make reasonable efforts to display product colours and images accurately.
The colour or appearance displayed on your screen may vary because of:
-
Device settings.
-
Screen quality.
-
Lighting.
-
Photography.
-
Manufacturing variation.
-
Product or packaging updates.
Reasonable colour variation may occur, particularly in apparel.
This does not limit your rights where a product is significantly different from its description, image or sample.
Health and Product Information
Information available through our website, stores, social media, customer service, body composition services or other communications is provided for general information and retail assistance.
It is not intended to be:
-
Medical advice.
-
A medical diagnosis.
-
A treatment plan.
-

You should seek advice from an appropriately qualified healthcare professional before using a supplement if you:
-
Have a medical condition.
-
Are pregnant or breastfeeding.
-
Are under 18.
-
Take prescription or non-prescription medicines.
-
Have allergies or sensitivities.
-

Stop using a product and seek appropriate advice if you experience an adverse reaction.
In an emergency, contact emergency services immediately.

Factors affecting results may include:

Diet.
-
Exercise.
-
Sleep.
-
Health.
-
Medication use.
-
Genetics.
-
Age.
-
Consistency of use.
-
Other lifestyle factors.
Testimonials, reviews, customer experiences and before-and-after content reflect individual experiences and do not guarantee that another customer will achieve the same result.
A product not producing a customer’s preferred or expected result does not necessarily mean that the product is faulty.
Nothing in this section limits your rights where a product does not meet a consumer guarantee.
Allergens and Dietary Requirements
Products may contain, or be manufactured in facilities that process, common allergens.
You are responsible for checking:
-
The physical product label.
-
The ingredient list.
-
Allergen statements.
-
Manufacturer warnings.
-
Suitability for your dietary requirements.
Website filters, product categories and descriptions such as “vegan”, “gluten free”, “dairy free”, “keto” or similar descriptions are provided using information available to us.
Manufacturing processes and formulations may change. Customers with allergies, intolerances or strict dietary requirements should verify suitability from the current physical label or manufacturer before use.
Contact the manufacturer or a healthcare professional if you are uncertain whether a product is suitable.
Body Composition Scans and Consultations
Where we provide body composition scans, questionnaires, product consultations or similar services:
-
Results may be affected by hydration, food intake, exercise, clothing, timing and other variables.
-
Measurements are estimates and may vary between scans or devices.
-
Results are provided for general informational and tracking purposes.
-
The service does not diagnose a medical condition.
-
Product discussions are general retail assistance and do not replace medical advice.
You are responsible for telling staff about any relevant circumstances that may affect whether a scan or service is suitable for you.
We may decline or stop a scan or consultation where we reasonably believe it may be unsafe, inappropriate or outside the scope of the service.
Health-related information is handled in accordance with our Privacy Policy.
Orders
An order submitted through our website is an offer by you to purchase the selected products at the displayed price, including any applicable delivery charges.
An automated order confirmation confirms that we have received your order. It does not necessarily mean that the order has been accepted.
We may accept your order by:
-
Sending confirmation that it has been accepted.
-
Dispatching the products.
-
Making the order available for collection.
All orders are subject to:
-
Payment approval.
-
Product availability.
-
Verification checks.
-
Delivery availability.
-
These Terms.
Order Refusal or Cancellation
We may refuse, limit or cancel an order where reasonably necessary, including where:
-
A product is unavailable.
-
There is an obvious pricing or product-information error.
-
Payment is declined or reversed.
-
We reasonably suspect fraud or unauthorised payment activity.
-
The order appears to be for unauthorised resale or commercial distribution.
-
Purchase limits have been exceeded.
-
The order breaches promotional terms.
-
The delivery address cannot be serviced.
-
The product cannot lawfully be supplied or delivered.
-
Fulfilling the order would create a safety, security or legal risk.
-
You have materially breached these Terms.
If we cancel an order after receiving payment, we will refund the amount paid for the cancelled portion using the original payment method, unless another method is agreed or required by law.
We will not cancel an accepted order merely because we later decide the agreed price was commercially disadvantageous.
Purchase Limits and Resale
Unless we agree otherwise, products purchased through our retail website are intended for personal or household use.
We may apply reasonable purchase limits to:
-
Products in limited supply.
-
Promotional products.
-
High-demand releases.
-
Products subject to manufacturer restrictions.
-
Products at risk of unauthorised resale.
-
Purchases that appear commercial in scale.
You must not falsely represent yourself as an ordinary retail customer to avoid a reasonable purchase limit.
Contact us before placing a commercial or wholesale order.
Prices
Unless otherwise stated, prices displayed on our Australian website are in Australian dollars and include GST where applicable.
Prices may change from time to time.
A price change will not affect an order already accepted by us, except where:
-
You request a change to the order.
-
There was an obvious pricing error.
-
A discount or promotion was applied contrary to its clearly disclosed terms.
-
Another adjustment is permitted by law.
Shipping charges, surcharges and other applicable costs will be shown at checkout or handled in accordance with our Shipping and Delivery Policy.
Pricing and Website Errors
We may correct genuine errors in:
-
Product descriptions.
-
Prices.
-
Discounts.
-
Promotions.
-
Shipping charges.
-
Availability.
-
Product specifications.
-
Website content.
If an obvious error affects an order before it has been accepted, we may contact you and offer the choice of:
-
Proceeding at the correct price or on corrected terms.
-
Changing the order.
-
Cancelling the affected order for a full refund.
We will not rely on this section to avoid an order merely because a promotion was more successful or less profitable than expected.
Payments
Available payment methods are displayed at checkout.
You confirm that:
-
You are authorised to use the selected payment method.
-
The payment information provided is accurate.
-
Sufficient funds or credit are available.
-
The transaction is not fraudulent or unlawful.
Payments may be processed by Shopify, banks, card providers, buy now, pay later providers or other payment service providers.
Your use of a third-party payment service may also be subject to that provider’s terms and privacy policy.
We generally do not receive or store complete payment card details.
Buy Now, Pay Later Services
Where a buy now, pay later option is available:
-
Approval is determined by the provider.
-
Your payment agreement is with the provider.
-
Repayments must be made according to the provider’s terms.
-
Refunds will generally be processed through the original provider.
-
You should continue scheduled payments until the provider confirms that the arrangement has been adjusted.
We are not responsible for fees charged by a provider because a customer stopped making required payments before a refund or adjustment was confirmed.
This does not limit any rights you have against ECS Supplements & Apparel under the Australian Consumer Law.
Discounts and Promotional Codes
Discounts and promotional codes:
-
Must be used in accordance with their stated terms.
-
Must be entered or applied before checkout is completed.
-
May have an expiry date.
-
May apply only to selected products, customers or sales channels.
-
May require a minimum spend.
-
May exclude gift cards, clearance items, subscriptions or specified products.
-
May not be combined with other offers unless expressly stated.
-
Have no cash value.
We may cancel or correct a discount that was obtained through fraud, technical manipulation, unauthorised distribution or a clear breach of the promotional terms.
We will not retrospectively apply a promotion to a completed order unless the promotion expressly provides otherwise or we choose to do so.
Promotions, Competitions and Giveaways
Promotions, competitions and giveaways may be subject to additional terms.
By participating, you agree to the specific terms displayed with the promotion.
Where required, promotional terms may address:
-

-
Notification.
-
Use of submitted content.

Unless otherwise required by law:
-
Gift cards cannot be exchanged for cash.
-
Gift cards should be treated like cash.
-
We are not responsible for unauthorised use where the customer failed to take reasonable care of the card or code.
-
Gift cards may be used only through eligible ECS Supplements & Apparel sales channels.
-
Gift cards cannot be used to purchase another gift card unless we permit it.
-
Lost or stolen gift cards may only be replaced where ownership and the unused balance can be reasonably verified.
Gift-card expiry dates will comply with applicable Australian law.
Loyalty Program
Participation in our loyalty program may allow customers to earn or redeem points, rewards, discounts or member benefits.
Loyalty benefits:
-
Are promotional benefits rather than cash.
-
Cannot be sold or transferred unless we expressly permit it.
-
May be subject to expiry periods disclosed in the loyalty program.
-
May not be earned on excluded products, fees or transactions.
-
May be adjusted where an order is refunded, cancelled or reversed.
-
May be subject to reasonable redemption limits.

May be unavailable during system outages.
We may correct points or rewards added because of:
-
A technical error.
-
A duplicate transaction.
-
A refunded or cancelled purchase.
-
Fraud.
-
Misuse.
-
A breach of the loyalty terms.
We may suspend or close a loyalty account where we reasonably believe it has been used fraudulently or abusively.
Where reasonably practicable, we will provide notice before making a material adverse change to the loyalty program. Any change will not affect rights that have already accrued where it would be unfair or unlawful to remove them.
Further loyalty terms may be displayed when you join or use the program.
Subscription and Recurring Orders
Where subscription or recurring-purchase options are offered, the applicable details will be displayed before you subscribe.
These details may include:
-
The products included.

The recurring price.
-
The billing frequency.
-
Available discounts.
-
Delivery charges.
-
How to pause, skip, change or cancel.
-
Any minimum commitment, if applicable.
-

By starting a subscription, you authorise the applicable recurring charges until the subscription is cancelled or otherwise ends.
You are responsible for reviewing upcoming order notifications and updating:
-
Products.
-
Quantities.
-
Delivery details.
-
Payment information.
-
Subscription preferences.
Any cancellation or change must be completed before the applicable processing cut-off shown in your account or subscription communications.
Where an order has already been processed or dispatched, it may need to be handled under our Returns, Refunds and Exchanges Policy.
We will not impose an undisclosed minimum term or cancellation fee.
We may change future subscription prices or benefits by giving reasonable advance notice. You may cancel the subscription before the change takes effect.
Product Availability
Products displayed on our website are subject to availability.
Adding a product to your cart does not reserve it.
If a product becomes unavailable after an order is placed, we may:
-
Offer an alternative product.
-
Supply the available portion of the order.
-
Place the affected item on backorder with your agreement.
-
Refund the unavailable item.
-
Cancel and refund the affected order.
We will seek your agreement before substituting a materially different product.
Pre-Orders and Backorders
Products offered for pre-order or backorder may have an estimated dispatch date.
Estimated dates are not guaranteed and may change because of:
-
Manufacturing delays.
-
Supplier delays.
-
Shipping disruptions.
-
Customs processing.
-
Events outside our reasonable control.
We will provide reasonable updates about material delays.
Your cancellation and refund rights will be governed by:
-
The terms disclosed when ordering.
-
The Australian Consumer Law.
-
Other applicable laws.
We will not retain payment indefinitely without providing the product, a reasonable update or an appropriate remedy.
Shipping and Delivery
Shipping rates, free-shipping thresholds, dispatch estimates, delivery arrangements and other shipping conditions are set out in our Shipping and Delivery Policy.
You are responsible for providing accurate delivery information.
Delivery dates are estimates unless we expressly agree to a guaranteed date.
Nothing in these Terms removes any responsibility we have for supplying an order within an agreed or reasonable time.
Returns, Refunds and Exchanges
Returns, refunds, exchanges and return-postage responsibilities are governed by our Returns, Refunds and Exchanges Policy.
Our voluntary change-of-mind policy operates in addition to your rights under the Australian Consumer Law.

-
Repair.
-
Replacement.

Refund.
-
Resupply of a service.
-
Cancellation.
-
Compensation for reasonably foreseeable loss or damage.
The remedy available generally depends on whether the failure is major or minor and on the circumstances of the transaction.
Nothing in these Terms limits those rights.
Disclaimers
To the maximum extent permitted by law:
-
General website content is provided for informational purposes.
-
We do not guarantee that website content will suit every person’s individual circumstances.
-
We do not guarantee a particular health, fitness, aesthetic or performance outcome.
-
We are not responsible for loss caused solely by a customer’s misuse of a product, failure to follow directions, unlawful conduct or unauthorised alteration of a product.
These disclaimers do not apply where they would exclude, restrict or modify a consumer guarantee or another right that cannot legally be excluded.
Limitation of Liability
Nothing in these Terms excludes or limits liability for:
-
Fraud.
-
Wilful misconduct.
-
Death or personal injury caused by negligence where liability cannot lawfully be excluded.
-
Breach of a consumer guarantee.
-
Any other liability that cannot legally be excluded or limited.
To the extent permitted by law, we are not liable for indirect or consequential loss that was not reasonably foreseeable and was not caused by our breach, negligence or unlawful conduct.
Where liability for a service can lawfully be limited, our liability may, at our option, be limited to:
-
Supplying the service again.
-
Paying the reasonable cost of having the service supplied again.
This limitation does not apply where it would be unfair, unlawful or inconsistent with the Australian Consumer Law.

Deliberate misuse of the website.
-
Unlawful conduct.

Terms that are intended to continue after termination.
Changes to Our Services
We may improve, modify or discontinue website features and services.
Where a change materially affects a paid recurring service or an existing customer commitment, we will provide reasonable notice where practicable and any remedy required by law.

-
You agree.
-
The change benefits you.
-
The change is required by law.
-
It is otherwise fair and lawful.
Severability
If part of these Terms is held to be invalid, unlawful or unenforceable, that part will be read down or removed to the minimum extent necessary.
The remaining Terms will continue to apply.
No Waiver
If we do not immediately exercise a right under these Terms, that does not mean we have waived that right.
A waiver is effective only if clearly communicated by the party granting it.
Entire Agreement
These Terms and the policies incorporated into them form the agreement governing your use of our website and related services.
They do not exclude:
-
Representations that cannot legally be excluded.
-
Consumer guarantees.
-
Rights arising from fraud or misleading conduct.
-
Specific written agreements between you and ECS Supplements & Apparel.
Governing Law
These Terms are governed by the laws of New South Wales, Australia and applicable Commonwealth laws.
